Abstract

The 1945 constitution states that the protection of citizens' rights as human beings must be respected. Confirmation of this is called the protection of human rights. This right is stated in the 1945 constitution through amendments. These provisions regarding human rights are mentioned in chapter xv starting from article 28a to article 28j. Every citizen has the right to obtain legal certainty, recognition, guarantees and equal protection before the law. Thus, it can be ensured that democratic values have been included in the Indonesian constitutional system. Handling of child detainees and juvenile convicts requires the presence of a community counselor who accompanies a child during the investigation period. Prosecution, as well as during trial and while serving a sentence in a state detention center or correctional institution. These children will be placed in the Juvenile Correctional Institution (LAPAS Juvenile), as mandated by Article 60 of Law Number 3 of 1997 concerning Juvenile Courts. The research that the author will carry out will be carried out using observational research methods. This means that this research will be carried out by directly observing and observing directly at the location of the incident or seeking direct information related to the data needed in the research by directly meeting sources who are directly related to the research object. According to Masri Singarimbun, survey research is research that uses the entire population to become respondents by using a method of obtaining data, namely interviews or questionnaires as a data collection tool. The implementation of fulfilling the rights of child prisoners, namely to obtain education and legal assistance at the Pekanbaru Class II A Correctional Institution, has not been running as it should, because the child has not had a proper education like children sent to public schools. Then, at the Class II A Pekanbaru correctional institution, the child has not received legal assistance as regulated by law The obstacle in fulfilling the rights of child prisoners to obtain education and legal assistance at LPKA is the lack of human resources in education and guidance for child prisoners so that children do not receive proper education as they should and children do not receive good legal services.
