Abstract

Customary law communities are units of legal communities that have an orderly value system, live in a certain area, have rulers, have tangible or intangible wealth, have customary law, and no one amongits members has the mind to break free from that bond. However, Paradatan, which is a customary law community group located in the Simangumban Julu Village area, does not meet the elements to be said to be a customary law community group in accordance with the elements stated by customary law experts. The main problem in this study is how the position of Toba Batak Customary in the Customary Law Community (MHA) system in the Simangumban Julu Village area, Simangumban District, and whether the Toba Batak Customary in the Customary Law Community (MHA) system in the Simangumban Julu Village area, Simangumban District is recognized by the State. This study used normative-empirical methods. And the nature of this research is descriptive analytical, while the data collection tools in this study are through interviews and documentation thatare relevant to the position of the Toba Batak Customary in the customary law community system (MHA) in the Simangumban Julu Village Area, Simangumban District, seen from the legal review. The results of this study show that the position of the Toba Batak Customary in the Customary Law Community System (MHA) in the Simangumban Julu Village Area is still very much needed by the customary law community there, Paradatan which is a customary law community group in the area was formed and born due to the needs in community life, especially life in the customary law community. Paradatan was formed on the basis of being qualified to form a customary law community group and was inaugurated by the local government at an inauguration party. And the Toba Batak Customary in the Customary Law Community (MHA) system in the Simangumban Julu Village area is recognized by the State through the local government in this case is the Village. The village provides recognition and protection because the village cannot entrust the existence of the customary law community there because all residents of the community are customary law communities are also members of one of the Paradatan and even those who work in the government come from the customary law community and become members of one of the Paradatan.
