Abstract
The reconstruction of the codification between the election law and the regional elections in Indonesia is a strategic step to create a more harmonious and effective legal system in the implementation of democracy. In the context of elections and regional elections regulated by Law Number 7 of 2017 and Law Number 10 of 2016, there are challenges related to overlapping regulations, coordination between institutions, and effective supervision. The goals that the author wants to achieve in this study are as follows: a. Reviewing and analyzing the Regulations on Elections and Pilkada Applicable in Indonesia. b. Reviewing and analyzing the Form of Reconstruction of Codification Between Election Law and Regional Head Election after Constitutional Court Decision Number 55/PUU-XVII/2019. The research methods to be used are Normative Law research, with types of Statute Approach and case approach. Research results show that the 2024 regulation on elections and elections in Indonesia is governed by several important regulations, including: Law Number 7 of 2017 on General Elections: Regulating the implementation of general elections for members of the DPR, DPD, and DPRD. Law Number 10 of 2016 concerning Regional Head Elections: Regulating the election of governors, regents, and mayors. Law Number 15 of 2011 concerning Election Organization: Regulating the mechanism of election organization related to administration and supervision. That the Form of Codification Reconstruction Between the Election Law and Regional Elections After the Constitutional Court Decision Number 55/PUUXVII/2019 is a simultaneous Election Design based on the Constitutional Court Decision Number 55/PUU-XVII/2019 reaffirmed the previous Decree, which was MK Decision Number 14/PUU-XI/2013 that the design of election uniformity became a constitutional requirement in the election implementation. The new thing in Constitutional Court Decision Number 55/PUUXVII/2019 is to provide six election uniformity designs that remain constitutional, with the condition that as long as they maintain the national election uniformity, namely the election of DPR members, DPD members, and President/Vice President.
