Abstract
Mediation is one way to resolve disputes through a negotiation process to obtain an agreement between the parties assisted by a mediator. The National Land Agency applies mediation as an alternative to resolving land disputes filed by applicants. Mediation conducted by the National Land Agency is voluntary, because mediation will only be carried out if there is a complaint from one of the parties who feels aggrieved by their land rights. However, the failure of mediation that occurred at the National Land Agency of Indragiri Hulu Regency is still relatively high, causing the implementation of mediation at the National Land Agency of Indragiri Hulu Regency to be less effective. The problems in this study are: 1) How is the resolution of land disputes through the mediation process by the National Land Agency of Indragiri Hulu Regency and 2) What are the inhibiting factors in resolving land disputes through the mediation process at the National Land Agency of Indragiri Hulu Regency. The research method used by the author is the empirical method, namely research conducted to obtain more complete data using interviews and questionnaires directly from the research location. The author conducted research at the National Land Agency of Indragiri Hulu Regency. The types and sources of data used are primary data and secondary data. The results of the study that the author obtained were that the implementation of mediation carried out by the National Land Agency of Indragiri Hulu Regency in resolving land disputes was in accordance with the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency No. 21 of 2020 concerning Handling and Settlement of Land Cases, but even though the National Land Agency has carried out the mediation process in accordance with the regulations, the mediation failure rate is still high, causing the implementation of mediation to be ineffective in resolving land disputes between the two parties. The factor that makes the mediation failure rate at the National Land Agency still high is because the parties do not have good intentions during the mediation process and the parties still maintain their respective egos.
