Abstract
Mediation is one of the peaceful efforts made by workers and employers if the settlement through bipartite or negotiation fails, mediation aims to reconcile the disputing parties by presenting a neutral party, namely a mediator where he is a third party who does not side with anyone so as to obtain fair results. A mediator who can help resolve industrial relations disputes is a mediator who is in an agency that has responsibility in the field of employment, one of which is the mediator of the Riau Province Manpower and Transmigration Service. The main problem in the study is how effective is the resolution of industrial relations disputes through mediation by the Riau Province Manpower and Transmigration Service in 2021-2023 and what are the supporting and inhibiting factors in resolving industrial relations disputes through mediation by the Riau Province Manpower and Transmigration Service in 2021-2023. This research is a sociological legal research, namely a direct review of a previously determined location or place using interviews and questionnaires as tools for data collection. While its nature is descriptive, which is one of the characteristics of research that aims to present a clear and detailed picture of the main research problem. The results of the study show that the resolution of industrial relations disputes through mediation by the Riau Provincial Manpower and Transmigration Service in 2021-2023 can be said to be effective. This can be seen from the greater number of joint agreements issued compared to the recommendations and supporting factors in the resolution of industrial relations disputes through mediation by the Riau Provincial Manpower and Transmigration Service are mediators who meet the requirements as stated in Article 3 paragraph (1) of the Decree of the Minister of Manpower and Transmigration Number Kep.92/MEN/VI/2004, mediators who carry out their functions and roles well, or the equality of the parties in the mediation process, and the parties, both workers and employers, who are serious about following the mediation process. Meanwhile, the inhibiting factors are that employers or workers cannot be invited to cooperate in resolving disputes that occur, there is high ego between the parties and the intervention of third parties which actually complicates the mediation process carried out by workers and employers.
