Abstract

The guidelines for determining forest areas in the Riau province are still based on the Decree of the Minister of Forestry Number 173/ktps - II of 1986 on June 6, 1986 concerning the designation of forest areas in the Riau Province level I area. The main problem in this study is the Mechanism for the Return of Limited Production Forest Areas by PT Arara Abadi Which are Used as Oil Palm Plantations Based on Law Number 6 of 2023 and Inhibiting Factors for the Mechanism for the Return of Limited Production Forest Areas by PT Arara Abadi Which are Used as Oil Palm Plantations Based on Law Number 6 of 2023. The research method used in this study is observational research which is descriptive analysis. The approach method is a qualitative analysis method. The data sources in this study are primary data sources and secondary data. The method of drawing conclusions in this study uses the deductive method. The results of this study indicate that First, the Mechanism for the Return of Limited Production Forest Areas by PT Arara Abadi Which is Used as an Oil Palm Plantation Based on Law Number 6 of 2023 Concerning Job Creation has not been implemented properly even though legal efforts have been made to the district court which resulted in Decision Number 17/Pdt-G/LH/2023/PN Bkn. PT Arara Abadi must return the 180 hectares of forest planted with oil palm to the basis of its permit, namely Limited Production Forest. The inhibiting factors for the failure to return the limited production forest area in Bencah Kelubi Village are the lack of awareness and obedience to the law from PT Arara Abadi, the difficulty of the return process because the land is very large, requiring a lot of costs and security personnel, and the lack of implementation of duties and supervision from the Ministry of Forestry and the Forestry Service.
