Abstract

Legally, the regulation on the import of used clothing is regulated by the government in several provisions of laws and regulations. The highest legal umbrella currently regulated in Law Number 7 of 2014 concerning Trade in Article 47 paragraph (1) states that every importer is obliged to import goods in new conditions. However, in certain circumstances the Minister of Trade may determine that imported goods are not new. This study aims to explain the legal protection for consumers regarding the circulation of imported used branded clothes in Pekanbaru City in 2022 (a case study at the Kodim Market) and the government's supervision of legal protection for consumers for the circulation of imported used branded clothes in Pekanbaru City. The research method used in this study is an empirical legal research method. The data used are primary data, primary data and secondary data. Primary data obtained from interviews and secondary data is data consisting of primary legal materials, secondary legal materials and tertiary legal materials. Data collection was carried out by means of literature studies and field studies. Data processing is carried out by systematizing the data which is analyzed qualitatively, namely by describing in writing and explaining in words, then the data is compared with laws and regulations, expert opinions, and the results of the analysis which the author will describe in a simple and systematic manner in sentence form. The results of the study concluded that the form of legal protection provided to consumers has not been fully implemented and government supervision efforts through the Pekanbaru City Industry and Trade Service to provide legal protection to consumers for the circulation of imported used branded clothes at the Pekanbaru Kodim Pasa include conducting supervision, namely direct involvement in the field. However, in reality the supervision carried out by the government is only limited to administrative appeals to traders of imported used clothing without any follow-up.
