Abstract

In Law Number 1 of 1974 Article 1 it is written "Marriage is a physical and spiritual bond between a man and a woman as husband and wife with the aim of forming a happy and eternal family based on Belief in One Almighty God". But there are still many who ignore the purpose of a marriage by carrying out marriages under the hand, where the marriage is a marriage that has no legal force so it is vulnerable to separation. The problem that is the subject of discussion is How is the Legal Protection of Children Born from Underhanded Marriages Based on Law No. 35 of 2014 concerning Child Protection? Child protection? This type of research is a type of normative research, in which this research is descriptive in nature, and the type of data used is primary data and secondary data, which consists of primary, secondary and tertiary legal materials. The status of a child born from an underhand marriage cannot be said to be a child in a legally valid marriage. In the eyes of the law, the status of a child is like a child out of wedlock. Underhanded marriages in the Marriage Act are not regulated. The Marriage Law only states that marriage is valid if it is carried out according to the laws of each religion and belief and is registered according to the applicable laws and regulations. Considering that the impact of underhand marriage is so widespread, there must be social control measures taken to prevent or reduce the possibility of unwanted things from happening in the future from various parties (government, KUA officials, village officials, etc.). Marriage is legally religious and recognized by the State in order to obtain legal certainty.
