Abstract

Forest fires in Indonesia are not only considered a regional disaster but also a global disaster. Because the impact of forest fires that spread to neighboring countries, as well as combustion gases (such as CO2) emitted into the atmosphere will cause global warming. International law becomes the basic provision in the settlement of transboundary air pollution cases. So in accordance with the provisions of international law, state responsibility arises when a country harms another country. The Stockholm Declaration, Rio Declaration, Geneva Convention, Kyoto Protocol and ASEAN Agreement on Transboundary Haze Pollution are international laws that are closely related to environmental protection and conservation of natural resources, including the protection of biodiversity. The main research problem is how the state’s responsibility for air pollution due to forest fires that occur in Indonesia according to international environmental law and how efforts in tackling air pollution due to forest fires that occur in Indonesia. The research conducted is descriptive normative legal research taken from secondary data, namely data obtained from literature studies by processing primary legal materials, secondary legal materials and tertiary legal materials. Based on the results of the research, it is understood that state responsibility means showing the juridical position after violation of the obligation to pay repairs. The government has made efforts ranging from preventive measures to countermeasures.
