Abstract
Lately there has been shocking news in the mass media regarding orders in the Go-Food service. The problem is the irresponsible actions of users of the Go-Food service feature by placing fake orders or fictitious orders. This is detrimental to the Go-Jek driver who has ordered the order. The legal protection of GOJEK partners for fictitious Go-Food orders made by consumers is also not optimal. Drivers should receive optimal protection and easy replacement and not make a loss in terms of time and material. This research examines the form of legal protection for online motorcycle taxi drivers against fictitious orders of Gofood in the Senapelan subdistrict and what are the obstacles in obtaining legal protection for online motorcycle taxi drivers (Ojol) for fictitious orders of gofood in the Senapelan sub-district based on Law Number 8 of 1999 concerning Consumer Protection The data collected are primary data and secondary data. The method used is descriptive qualitative. This research will examine the main issues according to the scope and identification of problems through a sociological approach. Based on the sociological research method, the data sources used in this research are secondary data sources which consist of 3 legal materials, namely: primary legal materials, secondary legal materials, tertiary legal materials. In this case, legal protection for GOJEK partners who experience fictitious orders due to consumer actions, the government is expected to immediately provide a legal umbrella for these GOJEK partners because GOJEK partners only carry out orders or orders that have been adjusted by the GOJEK application. In addition, the company PT. GOJEK Indonesia should reconstruct the clauses of the electronic agreement, reminding that currently there are many consumers making fictitious orders that can harm GOJEK's partners, both materially and immaterially. Barriers to Legal Protection for Online Ojek Drivers (Ojol) Against Fictitious Gofood Orders in the field, drivers say that they often receive fictitious orders and make them lose money and time. Due to the unknown mechanism for reimbursement of money, he and several of his colleagues chose to be sincere. There needs to be education and updating of mechanisms that are easy for drivers to learn and save drivers time. The drivers provide advice that cash payments at Gofood should be abolished, because the non-cash payment system is safer and makes it easier for drivers.
