Abstract

At the end of the second world war, advancements in many fields are attributed due to the war itself, and it’s consequences, including in the field of law. This caused the appearance of the first international tribunal formed by the allied countries to prosecute the leaders of the axis powers that have done many acts of cruelty that violates both the customs of war at the time, and also the basic values of humanity. But not all advancements are well received, nor are they all successful, the purpose of this study is to find out about how the International Military Tribunal for the Far East (IMTFE) handles the case concerning “Comfort Women” or otherwise known as Jugun Ianfu. That has long been known as one of the great failures in the IMTFE trials. This study is a normative-empirical study that will discuss about the implementation of a certain law, which in this case is The Slavery, Servitude, Forced Labour and Similar Institutions and Practices Convention of 1926 in the proceedings of the International Military Tribunal for the Far East (IMTFE). The data for this study can be divided into two, primary and secondary data. The study’s primary data comes from allied interrogation report of japanese prisoners of war and comfort women captured during the advance in the pacific theater. The study’s secondary data comes from a multitude of legal materials, which is divided into primary legal source which are sources of international law such as conventions, treaties, agreements, and such, secondary legal sources which are journals, books and other related sources, and the last is tertiary legal source which are other supporting sources that are relevant to the subject matter such as dictionaries, journals, internet sources, et cetera. The study has concluded that during the proceedings, the IMTFE court did not conclude the matters concerning “Comfort Women”. This is mainly due to 3 aspects, which are political, legal, and social aspects.
