Abstract

Work agreement according to the general provisions of Article 1 paragraph (14) of Law Number 13 of 2003 concerning employment is an agreement between a worker/laborer and an entrepreneur or employer which contains the terms, rights and obligations of the parties. In the employment relationship between employers and workers, the system of work agreements for a certain time (PKWT) is more often used by employers compared to work agreements for an unspecified time (PKWTT) or what are often called permanent workers. This thesis discusses how the implementation of work agreements for a certain time at PT. Adhi Karya Duri based on Law Number 13 of 2003 concerning Employment and how the legal protection for PT. Adhi Karya Duri based on Law Number 13 of 2003 concerning Manpower. The research method used by researchers is the sociological (empirical) legal research method, namely by direct observation of the field, by looking at the reality on the ground. In this study the data that researchers used were Primary Data and Secondary Data, in which Primary Data is data obtained from observations, interviews and questionnaires. While Secondary Data data obtained from books, legislation, journals and articles, and related literature. The results of the research and discussion are as follows: first, the implementation of a work agreement for a certain time at PT. Adhi Karya Duri that in making a work agreement for a certain time at PT. Adhi Karya Duri has not fulfilled the element of freedom of contract in drafting or making work agreements for a certain time. Second, legal protection for PT. Adhi Karya Duri based on Law Number 13 of 2003 concerning Employment such as the provision of K3 and social security has been carried out in accordance with applicable laws and regulations
