Abstract

The legality of adoption is the starting point in determining the correctness of the legal status of the person being adopted. Hadhanah is a right for husband and wife as well as children. In caring for and caring for children, it is the obligation of parents to children who take care of children before and after divorce. Hadhanah is obligatory for every parent to provide maintenance for their child. The purpose of this study was to find out the views of Islamic law on child rearing (hadhanah), whether adopted children get hadhanah as a result of the divorce of adoptive parents and to find out the inheritance rights of adopted children from adoptive parents who have divorced. This research uses a normative legal method which is a type of research in the category of library research and library research by collecting data from various literature related to the research material. The results of the study explain that the Compilation of Islamic Law stipulates that the cost of nursing children is borne by the father. If the father dies, it is borne by the person who is obliged to provide for the father or guardian. In the event of a divorce, children who are not yet mumayyiz or who are not yet 12 years old are looked after by the mother. After that, it is up to the child, who he chooses as the holder of the right to maintain the costs borne by his father. Mutual inheritance rights apply to adoptive parents in a legal marriage bond. As regulated in the Compilation of Islamic Law and the Book of Civil Law Laws. Even though adopted children are not entitled to mutually inherit from their adoptive parents, Islam still opens up opportunities for them to be beneficiaries while their adoptive parents are still alive.
