Abstract

Crime is referred to as a social phenomenon that is more influenced by various aspects of life in society such as economics, politics, socio-culture and other matters related to state security. Crime arises from these technological advances, one of the specific things that we encounter is the crime of sexual harassment or obscenity against women, both underage and those who are legally competent. he main problem in this study is how is the criminal responsibility of the perpetrators of sexual abuse against minors, how is the application of material criminal law to cases of child abuse in decision Number 1176/Pid.Sus/2021/PN.Pbr, and what are the legal considerations of the panel of judges in imposing crime against the perpetrators of the crime of sexual abuse of children in case Number 1176/Pid.Sus/2021/PN.Pbr. This research is classified as normative legal research. Normative legal research is a scientific research procedure to find the truth based on legal scientific logic from a normative perspective, namely research conducted by analyzing library materials or document materials. The results of the research that has been carried out by the author show that criminal responsibility for the perpetrators of obscene acts against minors has been proven legally and convincingly guilty of committing criminal acts of violence against children by force to commit obscene acts. The application of material punishment against the defendant by stipulating that the defendant is detained and remains in detention with imprisonment for 5 (five) years in prison. The judge's considerations in case 1176/Pid.Sus/2021/PN.Pbr still not in accordance with Article 82 of the Child Protection Law because the sentence imposed is far below the minimum threat.
