Abstract

Buying and selling online uses the Cash On Delivery (COD) payment method, business actors are in a weak position so that losses often occur due to the actions of consumers, because the Cash On Delivery (COD) system payments are made when the consumer has received the goods purchased, so when the consumer does not If you receive the goods purchased intentionally or unintentionally, the transaction is cancelled. Based on the background of the problem, the formulation of the problem was found as follows: First, how is the implementation of legal protection for consumers of mobile transactions through the Facebook platform group using the Cash On Delivery system in Tampan District, Simpang Baru Village, Pekanbaru City? Second, what are the obstacles to legal protection for consumers making mobile transactions through the Facebook platform group using the Cash On Delivery system in the handsome subdistrict, Simpang Baru sub-district, Pekanbaru City? Third, what are the legal remedies that can be taken by consumers or business actors if they are disadvantaged in transactions through the Cash On Delivery system via Facebook media in the Tampan District, Simpang Baru Village, Pekanbaru City. This type of research can be classified as sociological (empirical) legal research, because in this research the author directly conducts research at the location or place under study in order to provide a complete and clear picture of the problem under study. The conclusions that can be obtained from the research results are First, the implementation of legal protection for consumers buying and selling cellphones through the Facebook platform group using the Cash On Delivery system includes the delivery of goods used as objects of sale and purchase and guarantees hidden defects in the goods they sell, and guarantees legal security for consumers from interference from other parties and the main obligation of the consumer is to pay the purchase price at the time and place as determined according to the agreement. Second, barriers to legal protection for consumers of mobile transactions through the Facebook platform group using the Cash On Delivery system, namely unilateral cancellations made by consumers. Unilateral cancellation occurs when the consumer or seller cancels an order without the consent of the other party. If in other areas of law this violates the law of default, namely one party is unable to fulfill the agreement that has been made together and without the consent of the other party. Third, legal remedies that can be taken by consumers or business actors if they are disadvantaged in transactions through the Cash On Delivery system via Facebook media, namely if there is a violation of the rights and obligations committed by the seller and harms the buyer, there will be a dispute which can be resolved in three ways, namely negotiation or mediation, settlements through consumer settlement agencies and through courts.
