Abstract
The crime of petty theft is a theft that has the elements of the main theft, but because it is added to other mitigating elements, the threat of punishment becomes light. The crime of petty theft, which is a type of petty crime, is a type of crime that can be resolved using a restorative justice approach. Restorative justice is the settlement of criminal acts by involving perpetrators, victims, families of perpetrators, families of victims, community leaders, religious leaders, traditional leaders, or other stakeholders to jointly seek a just solution through peace with an emphasis on recovery. The main problem in this study is how to apply restorative justice to minor theft crimes in the Mandau Sector Police area and what the obstacles are to the application of restorative justice to minor theft crimes in the Mandau Sector Police area. The research was carried out using empirical legal research methods using research or field observations by way of surveys directly in the field to collect primary data and secondary data obtained from respondents through interviews to be used as data or information as material for writing in this study. Based on the results of the research, it can be seen that the application of restorative justice to minor theft crimes in the Mandau Sector Police area has been running well since the beginning of 2021. The Mandau Sector Police have made restorative justice a priority in handling minor criminal cases such as minor theft crimes. And the obstacles in the application of restorative justice to the crime of petty theft in the Mandau Sector Police area, namely perpetrators who are recidivists, perpetrators who are unwilling to take responsibility, and parties who are not cooperative in the process of implementing restorative justice.
