Abstract
The Kampar Regency Regional People's Representative Council (DPRD) is a regional people's representative institution authorized to carry out three functions: forming regional regulations, budgets and supervision. This study examines the use of one of these three functions, namely the formation of regional regulations submitted by local governments and those sourced from DPRD proposals. There is a phenomenon that implementing the function of forming regional regulations by the Kampar DPRD as mandated by law has not been running well and optimally, which is marked by the low productivity of council members in proposing draft regional regulations. This study aims to conduct a study on the Effectiveness of the Implementation of the Function of Forming Regional Regulations of the Kampar Regency DPRD in the Implementation of Regional Autonomy Based on Law Number 23 of 2014 concerning Regional Government with two problem formulations, namely how the authority of the DPRD in the formation of regional regulations according to Law Number 23 of 2014 concerning Regional Government, and the effectiveness of the implementation of the function of forming Regional Regulations of the DPRD Kampar in the implementation of regional autonomy based on Law Number 23 of 2014. This descriptive research describes the object to be researched and then explains it based on field facts. The type of research is empirical (field research) or field research, the object of which is a phenomenon that occurs in the Kampar Regency Regional People's Representative Council in the implementation of the function of forming regional regulations. The legal analysis used is based on the science of constitutional law, which includes laws that have been in force, are in force (ius constitutum) and laws that should be (das sollen). The conclusion of this study, based on Law Number 23 of 2014 concerning Regional Government, is that the Kampar Regency DPRD has apparent authority in forming regional regulations, including the right to initiative, discussions with regional heads, and supervision of the implementation of regional regulations. However, this authority has not been implemented optimally. The legislation process is often hampered by weak planning, lack of harmonization with higher laws and regulations, and low quality of the substance of local regulations. In addition, community involvement in the preparation of local regulations is also very minimal, so the resulting regulations do not fully reflect the needs and aspirations of the community. The DPRD's initiative rights are not utilized optimally by DPRD members.
