Abstract

The Regional Government carries out the administration of the regional government through two institutions, namely the Regional Head and the Regional People's Representative Council (DPRD). The Regional Head and DPRD are the implementers of government affairs in the region who have equal positions, and both offer the implementation of government in the region through their duties and authority. The Kampar Regency DPRD is a regional people's representative institution whose composition and position have been regulated through Law Number 23 of 2014 concerning the Regional Government. Unfortunately, the law does not detail how the DPRD carries out the checks and balances mechanism in carrying out its functions, so the council cannot encourage the optimization of regional government performance in the context of implementing decentralization in the region. This research aims to analyze "The Principle of Checks and Balances and its Implications for the Work Procedure Relationship Between the Kampar Regency DPRD and the Regional Government in the State Administration System" with two problem formulations, namely how to check and balances mechanism and enforce it on the work system relationship between the Kampar Regency DPRD and the Government Regions in the constitutional system? How is the principle of checks and balances implemented by the Kampar Regency DPRD in its monitoring function to form regional regulations? This type of research is empirical (field research) or field research whose object is the implementation of the principle of checks and balances and its implications for the working relationship between the DPRD (Regional People's Representative Council) of Kampar Regency and the Regional Government in the Indonesian constitutional system with the research object being the implementation of the principle of checks and balances. Balances and their implications for the working relationship between the Kampar Regency DPRD and the Kampar Regency Regional Government as regulated in Article 207 paragraph (1), paragraph (2) and paragraph (3) of UU and Number 23 of 2014 concerning Regional Government. This research concludes that, even though the law does not regulate a checks and balances mechanism, the checks and balances mechanism for the working relationship between the Kampar Regency DPRD and the Regional Government is carried out by the DPRD leadership together with other organs of other councils, such as the Budget Agency, the Deliberation, Regional Regulation Formation Body, Honorary Body, Fractions and Commissions carry out their duties and authority by the council's rules and regulations. The implication of checks and balances by the Kampar Regency DPRD in its monitoring (controlling) function in forming regional regulations is the achievement of mutual agreement in forming regional regulations.
