Abstract

E-Commerce is an electronic buying and selling transaction via the internet. E-Commerce is a form of trade that has its own characteristics, namely that consumers and business actors do not meet, but rather through the internet. By not meeting the two parties in the transaction, disputes often occur which are detrimental to consumers. The aim of this research is to find out the mechanisms and legal consequences that arise as well as legal protection and solutions for consumers who buy Smartphones with Black Market status in E-Commerce in terms of Law No. 8 of 1999 concerning Consumer Protection. The main problem in this research is how to monitor the sales of Smartphones with Black Market status in E- Commerce in accordance with Law No. 8 of 1999 concerning Consumer Protection? And what is the legal protection for consumers who buy Smartphones with Black Market status in E-Commerce in accordance with Law No. 8 of 1999 concerning Consumer Protection case study Panam branch)? In this research, the type of research used is Empirical Law/Sociological Law research, namely research that aims to observe and describe the symptoms that occur in both natural and social phenomena, which occur within a certain time level with the sampling method being purposive sampling. namely sampling that is only adapted to the researcher's objectives, in order to achieve the aims and objectives of this research. Based on the research results, the implementation of supervision of circulating goods carried out by the Pekanbaru City PPKUKM Service, especially circulating goods for Black MarketSmartphone products, is not yet running, because supervision of Black MarketSmartphones is carried out only if there are complaints from the public if it is known that business actors are selling Black MarketSmartphones. And there are two legal protections, namely preventive legal protection and repressive legal protection. In preventive legal protection, the Ministry of Industry has blocked unregistered Smartphone IMEIs and this is quite effective. Repressive legal protection is a type of legal protection that is given when a dispute arises, which can be in the form of sanctions, both administrative sanctions such as fines and compensation and criminal consequences such as imprisonment or imprisonment. However, there are still consumers who are deceived into buying Smartphones with Black Marketstatus. However, they are reluctant to take legal action to obtain legal protection, so that repressive legal protection is still not implemented properly and has a deterrent effect on perpetrators who sell Smartphones with Black Marketstatus.
