Abstract
The development of e-commerce in recent years can be said to have grown very rapidly, one example is online buying and selling sites. On online buying and selling sites, there are many well-known online sales systems, one of which is the PO (Pre Order) system, even though it is the most popular system, it does not rule out the possibility of various cases of default arising in it. There have been several cases that have resulted in losses felt by the seller in a buying and selling transaction using the PO (Pre Order) system. The main problem of this research is what form of legal protection exists for business actors who suffer losses due to unilateral cancellations by consumers and what are the obstacles in obtaining legal protection for business actors against consumers who make unilateral cancellations by consumers in the PO (Pre Order) system. The method used in this research is empirical legal research with a survey method, research carried out directly at the research location that has been determined with the aim of obtaining information and explanations that support the author's research, while the nature of this research is analytical descriptive, which the author describes clearly problems that will be researched by the author. The results of the author's research show that the validity of an online buying and selling agreement (e-commerce) using the PO (Pre Order) system is considered valid if the four conditions for the validity of an agreement as stated in Article 1320 of the Civil Code are met. In the objects studied by the author, there were losses suffered by business actors due to consumers not fulfilling their obligations, such as not taking the goods they had ordered. Consumers who make unilateral cancellations at the Annisa online shop are given sanctions by the business actor, namely being blacklisted or no longer able to follow the pre-order system at the Annisa online shop.
