Abstract

Defaults in Tokopedia E-Commerce cause losses to consumers which are caused by irresponsible business actors. as well as the settlement process from Tokopedia start-ups to consumers regarding products sent that are not appropriate and different from those displayed in the estalage. Consumer electronic transactions are often harmed by parties who commit acts of violating the agreement and the dispute resolution provided is considered to be detrimental to one party. The thesis entitled "Settlement of Defaults in E-Commerce Transactions (Case Study in Start-up Tokopedia)" discusses the formulation of the problem as follows: 1) how to settle defaults in E-commerce transactions, study in Start-up Tokopedia 2) what are the obstacles to settlement of defaults in E-commerce transactions, study in Start-up Tokopedia. The method used to answer the research mentioned above is to use the Empirical Sociological Research Method, which is a data collection technique in which the research makes direct observations of the research object to take a close look at the activities being carried out. Data collection methods were carried out by interviews, questionnaires and observation. The research results are: settlement of defaults in the sale and purchase transaction of the start-up Tokopedia, there is a process of stages from customer service referring to the company's SOP through the results of the mediation process from the customer service. the mediation process is not completed, the compensation and convenience that should be contained in article 4 paragraph 1 letter h have not been received and consumers can file a lawsuit based on the consumer protection law and article 1243 of the Civil Code and Law Number 9 of 2016 concerning Information and Electronic Transactions. Constraints to defaults in Tokopedia start-up buying and selling transactions, namely: defaults committed by business actors, objections to returning goods, long estimated returns and low consumer knowledge and lack of good faith from business actors.
