Abstract

In the Toba Batak Customary Law Society in terms of the Distribution of Inheritance Rights adheres to a patrilineal kinship system where this kinship system draws the Lineage of the Male (Father). For this reason, this study wants to know about the Implementation and Constraints that occur in the Distribution of Inheritance Rights of Sons in the Toba Batak Customary Law System in Pinang Village, Sebatang Timur, Perawang, Tualang District, Siak Regency. This research has two formulations of the problem, namely: the Implementation of the Distribution of Inheritance Rights of Sons According to the Toba Batak Customary Law System in Pinang Sebatang Timur Perawang Village, Tualang District, Siak Regency and Obstacles in the Distribution of Inheritance Rights in the Toba Batak Customary Law System in Pinang Sebatang Timur Perawang Village, Tualang District, Siak Regency. This type of research uses the Empirical Legal Research Method (observational research), which uses data collection tools in surveys and interviews, so that this research is carried out directly at the location or place of the incident. While the nature of this research is analytical discriptive, namely research that describes and explains the reality in the field regarding the Implementation of the Distribution of Inheritance Rights of Sons in the Toba Batak Customary Law System in Pinang Village, East Sebatang Virging, Tualang District, Siak Regency. The results of the research obtained by the author are the implementation in the distribution of inheritance rights of sons in Pinang Sebatang Timur Village is still carried out in accordance with the Toba Batak Customary Law where sons become the main heirs in receiving inheritance from their parents. But over time, the development of the mindset of the Toba Batak Community in East Sebatang Pinang Village also changed where in this study Girls also get Inheritance Rights from their Parents, it's just that the number is different from Boys. The obstacles in the Distribution of Inheritance Rights are such as discrepancies and injustices in the distribution of inheritance among sons which trigger disputes between sons in the family.
