Abstract

Kerapatan Adat Nagari (KAN) is a Kerapatan adat institution from Niniak Mamak which has been inherited from generation to generation which functions to maintain the preservation of customs and resolve sako jo pusako disputes. In this case, the Nagari Traditional Community plays an important role in the midst of indigenous communities. For this reason, this research wants to know about the role of the Nagari Customary Meeting in resolving customary land disputes that occurred in Kenagarian Bukik Limbuku, Limapuluh Kota Regency, West Sumatra Province. Formulation of the problem in this research is to find out the role of the Nagari Traditional Community Institution in the process of resolving communal land disputes, as well as what are the inhibiting factors in resolving communal land disputes in Kenagarian Bukik Limbuku, Limapuluh Kota Regency, West Sumatra Province. In this study, the author uses the Empirical Legal Research Method (Observational research) where the data collection tool is carried out by means of a survey to obtain accurate data through interviews, so that this research is carried out directly at the Research Location, and the nature of this research is descriptive analysis which explains the main problem being studied. Based on the author's analysis, the results of this study explain that the Kerapatan Adat Nagari (KAN) in Nagari Bukik Limbuku in the settlement process is as a mediator, as a motivator for the disputing parties, as a peacemaker and as a decision maker from the deliberations carried out by the niniak mamak who are members of the Kerapatan Adat Nagari, However, KAN in Bukik Limbuku has not carried out its role optimally. Meanwhile, the inhibiting factors of the Kerapatan Adat Nagari (KAN) are internal factors caused by temperament, education level, and discipline and external factors that come from third parties who come from families or relatives who are in dispute.
