Abstract
The author conducted research with the title “Law Enforcement by Civil Servant Investigators of the Food and Drug Supervisory Agency Against the Crime of Circulating Traditional Medicines Without a Distribution Permit in Dumai” because currently many people consume traditional medicines which they believe can have an instant effect without dangerous side effects. This is because traditional medicines come from natural ingredients, but currently there are many traditional medicines circulating without distribution permits which contain medicinal chemicals whose doses exceed reasonable limits and ingredients that should not be contained in traditional medicines. If consumed without a doctor’s prescription, will cause dangerous side effects. This research discusses law enforcement by BPOM civil servant investigators regarding the crime of distributing traditional medicines without a distribution permit in Dumai and what obstacles are faced by BPOM civil servant investigators in carrying out law enforcement in Dumai. The research use sociological research methods that are descriptive analytical in nature. The data obtained is based on the results of interviews. The results of research and data analysis carried out by the author regarding law enforcement by BPOM civil servant investigators regarding criminal acts of distribution of traditional medicines without a distribution permit in Dumai were carried out in accordance with article 197 of Undang-Undang Nomor 36 Tahun 2009 concerning health and in accordance with Decree Head of BPOM. The obstacles faced in enforcing the law against this criminal act are the lack of civil servant investigators, the lack of BPOM investigators who cannot carry out arrests, and the lack of budget for enforcing the law.
