Abstract

In the car rental agreement at Evan Rental Car Pekanbaru, problems have occurred several times, especially between the party renting the vehicle and the renter, namely in terms of the trust given by the renting party to the renter, where this trust is often misused by the renter in renting out the vehicle. So those who rent out often feel disadvantaged by the renter, for example the renter does not pay for a car that has been scratched or the renter does not return the car on time, therefore the renter can be said to have not completed his obligations. In this research the author has a main problem, namely: How is the rental agreement process between the parties in renting a car at Evan Car Rental Pekanbaru and how are efforts to resolve obligations in the car rental agreement at Evan Car Rental Pekanbaru The type of legal research method that researchers use in their thesis research is sociological legal research, while in terms of its nature it is descriptive analytical. The results of the author's research are that the process of renting a car at Evan Car Rental requires that you fulfill several requirements such as Resident Identity Card, Driving License, minimum deposit of IDR. 500,000 and after agreeing, the consumer is directed to sign a rental agreement that has been made by Evan Car Rental. This agreement is a written agreement where there are terms and conditions that must be agreed upon by the parties so that a rental agreement arises. The renter makes an agreement with Evan Rental Car in which the agreement provides protection for both parties to understand each other's rights and obligations as well as the consequences if they violate the agreement. And legal problems in the implementation of the agreement must be resolved by the parties who made it by prioritizing a sense of justice, namely by trying to provide wise solutions to every problem that occurs. If the renter returns the rental object damaged or not in accordance with its original condition, then the renter is obliged to be responsible for all damage caused by him unless the renter can prove that the damage was not his fault. However, if the renter is late in returning the rental car, there will be a form of material sanction that must be paid by the renter to the car rental owner..
