Abstract

In connection with forfeiting points when a member cannot close points there is a doubt about the law, whether allowed or not. Considering that there are reduced member rights where he has accumulated points for one monst even though he does not meet the 100BP requirement. For that burn points can be analyzed using Islamic Law. Because, the application of closing points in a Multi Level Marketing company cannot be said to be lawful or unclean directly, but must be seen from the practices that occur in the field. As for the main problem in the first thesis research, how is the execution of the contract forfeited points for oriflamme members and that is the view of Islamic la w on forfeited points for oriflamme members. Is type of legal research used is the normative-empirical method. As well as the nature of this research is analytical descriptive, while the data collection tool in this research is through interviews, questionnaires and documentation relating to the burn point system at multi-level marketing for Oriflame members reviewed from Islamic law to be compiled systematically and then analyzed using legal provisions Islam by using the jua'alah agreement and Fatwa of the National Sharia Council No.75/DSN-MUI/VII/2009 concerning Guidelines for Direct Selling in Tiered Sharia to draw conclusions. The results of the research show that first, the results of the poin burn poin system at oriflamme is a system where if a member cannot close points by 100BP, then the points he has accumulated in one period or one month will be forfeited. Second, forfeited points for Oriflame members if analyzed according to the perspective of Islamic Law using a ju'alah contract are appropriate because they have fulfilled the pillars and conditions of ju'alah. As if analyzed using the Fatwa of the National Sharia Council No.75/DSN-MUI/VII/2009 concerning Guidelines for Direct Sales of Sharia Stages, it is also appropriate, especially in the seventh point, there may not be regular commissions without coaching and selling goods or services. At the end of writing this thesis, the author advises the public to be more selective in choosing a Multi Level Marketing business, especially by studying the system applied to Multi Level Marketing so that they are not trapped in a business under the guise of containing a money game system, then this Oriflame Multi Level Marketing is expected to continue to run the business system that is implemented that it continues to comply with sharia value.
