Abstract

Legal protection of intellectual property rights in the copyright sector is very concerning, especially piracy of copyrighted works in the field of music. Piracy of copyrighted works of music is done through various media, be it in the form of cassettes, VCDs, DVDs, and others. Especially regarding the piracy of cassettes from year to year is increasingly rampant. The emergence of this piracy is inseparable from the economic and social conditions of society to be increasingly degenerate and disorganized. The circulation of pirated VCDs/DVDs is very widespread and easily available, including at street or roadside stands. Price inequality is one of the causes of rampant VCD/DVD piracy, consumers who want to enjoy at low prices will be more interested in buying than having to buy the original or original, thus spurring pirates to increase the production of pirated VCD/DVD. The research conducted is using a type of sociological research, namely the author examines directly into the field by conducting interviews with sources as primary data and secondary data in processing data from primary legal materials, secondary legal materials and tertiary legal materials, and also this research manages existing data using qualitative analysis. The purpose of this research is to explain and understand how copyright protection related to the circulation of pirated VCD and DVD tapes based on law number 28 of 2014 concerning copyright, as well as knowing how legal efforts made by songwriters against the circulation of pirated VCD and DVD tapes. The conclusion of this research is that economic factors are the dominant factor in the emergence of cassette piracy in addition to social, cultural, educational and law enforcement factors. Legal efforts against cassette piracy have not been implemented optimally because there are still many pirated cassette products sold in the community. Because the selling price of pirated VCD/DVD tapes is cheap, so people tend to choose to buy cheap and affordable rather than buying original VCD/DVD tapes because the price is very expensive. Hence this is the task of government officials and law enforcement officials in eradicating the circulation of pirated VCD / DVD tapes by providing strict rules in the protection of copyright and enforce the law in accordance with the law on copyright, so that creators of works of art do not feel harmed and they can work again by producing the best works of art.
