Abstract

This research analyzes the use of online gambling in Indonesia as a form of transnational crime based on the United Nations Convention on Transnational Organized Crime (UNTOC). The rapid development of online gambling since the advancement of information technology has made it develop across national borders. Although online gambling activities are prohibited by Indonesian national law, the practice of these crimes is still occurring. Its online nature makes it easier to access through websites and applications operated from abroad, this makes law enforcement more complex. This research uses normative research methods through theoretical approaches in the form of literature studies and legal products such as legislation or international conventions that are used as international standards in regulating the topic of discussion. In addition, it is also accompanied by data as resources to support the research. The results show that online gambling in Indonesia meets the criteria for being called a transnational crime based on UNTOC. This is because its operation involves more than one country and has a serious impact on the country's economic stability so that international cooperation is needed to combat it. The challenges in combating this phenomenon also reveal that the national legal framework is not comprehensive enough to tackle it, so this research suggests the urgency of passing legislation that will serve as the main law and revision of laws governing online gambling in Indonesia. Therefore, this research contributes to understand the dynamics of online gambling crime in Indonesia as a transnational crime and the efforts to combat it according to international standards.
