Abstract
In the era of globalization, human needs are increasing. This encourages various companies to innovate. PT. Aplikasi Karya Anak Bangsa (Gojek) is a technology company that offers various services engaged in transportation. The presence of Gojek also raises various problems, one of which is fictitious orders made by consumers through the Gojek application, especially in the food delivery service (GoFood). The formulation of the problem in this study is How is the legal protection of Gojek Drivers due to fictitious Go-Food orders in Pekanbaru City in terms of Law No.8 of 1999 concerning Consumer Protection and How is the responsibility of PT. Aplikasi Karya Anak Bangsa (GOJEK) Operational Office to GOJEK Drivers due to fictitious Go-Food orders in Pekanbaru City. The method used by the author in this research is empirical legal research, namely legal research conducted by analyzing and examining a problem of the operation of law in society directly either by interviewing or by making an observation. While the nature of the research is descriptive thus the author provides a clearer picture and explanation of the Legal Protection of Gojek Drivers due to fictitious orders in Pekanbaru City. tools to collect data in this study are through interviews and questionnaires relating to the problems studied. The results of this study indicate that consumers do not understand and carry out their obligations as consumers. Fictitious orders made by consumers cause losses to gojek drivers. Legal protection of Gojek drivers can be done in two ways, namely preventive legal protection and repressive legal protection. The losses experienced by Gojek drivers are in the form of material but also time and energy related to the decline in gojek driver performance. Material losses can be compensated to Gojek drivers, if Gojek drivers contact the call center or directly report to the gojek office. The responsibility of PT. Karya Anak Bangsa Application to Gojek Drivers Pekanbaru has not been maximally implemented, but PT. Karya Anak Bangsa Application acknowledges that it is responsible for its partners, namely Gojek Drivers.
