Abstract

PT. Tribakti Sarimas Pekanbaru is a company operating in the oil palm plantation sector. In supervising employee performance, an employment agreement is required. An employment agreement, according to Abdul Rachman Budiono, is a “legally binding contract” that outlines the responsibilities and rights of employers and workers. At the same time, employers assert their rights by providing wages or gifts. ideal for the job. The author formulates the main problem that will be discussed regarding how to implement collective work agreements between absent workers and the Company based on Law Number 13 of 2003 concerning Employment at PT Tribakti Sarimas and how to resolve obstacles in implementing collective work agreements between absent workers and the Company based on Law Number 13 of 2003 concerning Employment at PT Tribakti Sarimas. This type of research is empirical legal research using observational or field research by means of direct surveys in the field. The type of data used in this research comes from primary and secondary data. Primary data was obtained through interviews. Meanwhile, secondary data was obtained from the results of library research. The nature of this research is analytical descriptive which provides an overview of a research object through the data that has been collected. Based on the research results, it can be understood that the implementation of the collective work agreement between absent workers and the Company based on Law Number 13 of 2003 concerning Employment at PT Tribakti Sarimas is in accordance with existing laws and regulations. This is also proven by the existence of evidence of the collective work agreement that was made. The PKB regulates the wage system which includes basic wages, fixed allowances and nonfixed allowances. As well as efforts to resolve obstacles in the implementation of collective work agreements between absent workers and the company based on Law Number 13 of 2003 concerning Employment at PT Tribakti Sarimas, firstly, in the negotiation and implementation process of the Collective Work Agreement (PKB), there are several factors that often hinder its smooth running. . Second, the lack of effective communication between the two parties is also an obstacle. Third, a lack of understanding of the applicable laws and regulations is also an obstacle. Both employers and labor unions sometimes do not understand each other's rights and obligations, making it difficult to formulate PKB articles that comply with legal provisions.
