Abstract
People's Credit Banks (BPR) provides deposit interest rates that are higher than those set by the Deposit Insurance Agency to attract deposit customers' interest." Determination of the guarantee interest rate for People’s Credit Banks (BPR) deposits for the period 1 June 2024 to 30 September 2024 is determined through a notification letter from the Deposit Insurance Corporation (LPS) (No.: Peng-4/DSPS/2024). The standard interest rate for the Deposit Insurance Corporation (LPS) is 6.75%, but in practice, there is still People’s Credit Banks (BPR) that provide deposits to customers at a higher interest rate, namely 6.80%, to attract customers to deposit at the bank. Regarding this thesis research, there are several legal issues, namely as follows, first, what are the legal regulations regarding deposit insurance institutions (LPS) in Indonesia to guarantee the security of customer deposits in Indonesia? Second, what is the legal protection for customers whose deposits are above the deposit insurance institution (LPS) interest rate? This research uses empirical juridical methods with a case study approach and qualitative analysis. Data was collected through interviews with banks, customers, documents. The author conducted research using research, namely directly going into the field to collect the required data related to the research being carried out. Material obtained from primary data is processed then compared with secondary data then conclusions are drawn and described descriptively and analyzed qualitatively. From the results of the research and discussion, the researchers found the following: First, it shows that People's Credit Syariah Bank (BPRS) Hasanah in Pekanbaru City has complied with the provisions contained in the regulations of the Deposit Insurance Corporation (LPS) and carried out socialization regarding ethnic boundaries guaranteed interest. However, some customers still chose deposits with interest rates above the guarantee limit, which means they do not get protection from the Deposit Insurance Corporation (LPS). This emphasizes the importance of education and outreach regarding the risks of high interest rates. Second, legal protection for customers with interest above the Deposit Insurance Corporation (LPS) limit need to be improved through additional regulations or increasing customer awareness of the risks they face if they continue to make deposits with interest rates that were not guaranteed by the Deposit Insurance Corporation (LPS).
