Abstract
The discussion is about the case of debts and receivables where the Plaintiff committed two legal acts that contradicted each other at one time, namely the Debt Acknowledgment Letter Number 08 dated April 28, 2017 and the Sale and Purchase Agreement and Power of Attorney Number 09 dated April 28, 2017 Furthermore, with the existence of these two legal acts, Defendant I unilaterally changed the name of the debt collateral. This situation is of course very detrimental to the Plaintiff as the party who has paid its debt to Defendant I. The problem raised in this study is how the case position of case number 143/Pdt.G/2021/PN.Dpk and how is the process of proving case number 143/Pdt.G/2021/PN.Dpk so that the judge declares that defendant I, defendant II, defendant III, and defendant I have committed an unlawful act (onrechtmatige daad). To discuss this problem, a normative (normative juridical) research was carried out using the analysis of data and documents obtained, in this case it was identified that there was an unlawful act in the form of the action of Defendant I who had reversed the name of the Land Certificate which was the collateral of the debt into the name of Defendant I. Defendant I's act was a mistake that committed an unlawful act.
