Abstract
Advances in technology have had a major influence on aspects of human life, including muamalah. With the advancement of communication and information, it has also created many new forms of muamalah, such as the Online Buying Services business that is currently developing. This development needs to be supported by a good understanding of sharia to answer whether the act is lawful or whether there is an unlawful element so that it becomes null and void. Based on this description, the author feels the need to conduct research on the practice of online buying and selling services. This study aims to answer how online buying and selling services are practiced on the Instagram account @thailand_jastip and what is the view of Islamic law on the practice of online buying and selling services on the @thailand_jastip Instagram account. This research is an empirical normative research, namely normative legal research that is supported and equipped with empirical data in the form of data and facts obtained directly from the field. Data collection techniques were carried out through observation, interviews and documentation. Data analysis was carried out using qualitative methods, namely by describing or describing the problems to be studied along with the data, then the data obtained was compared with regulations, and existing literature as well as the opinions of Islamic jurists for later analysis. From the results of this study, two conclusions were obtained, namely: first, payments made by jastip providers on the @thailand_jastip account. @thailand_jastip is one of the jastip providers in Pekanbaru that offers safekeeping for purchases of goods originating from Thailand. @thailand_jastip sets a fee of 25% of the price of the goods ordered. For the total payment, the jastip will calculate the price of the item plus the jastip fee per item which will be calculated in rupiah value. However, in the payment system, unlike other jastip accounts which implement a full payment system in advance, the jastip account @thailan_jastip implements a payment system in the form of a DP of 75% of the total payment, then the rest will be paid after the goods arrive in Indonesia. Second, that the system implemented by @thailand_jastip is not in accordance with the principles of muamalah which should be regulated in the Koran and hadith, because there has been a merger of two contracts, namely the wakalah bil ujrah contract and the qard contract. Meanwhile, in muamalah, there is a hadith of the Prophet S.A.W which prohibits combining two or more contracts (multiple contracts) in one transaction, including the prohibition on combining qard contracts and ijarah contracts.
