Abstract

Buying and selling land is the process of transferring property rights in the form of goods or assets to another party using money as a means of exchange. Article 1457 of the Civil Code explains that buying and selling is an agreement by which the other party pays the promised price. The main problem in this research is what are the legal consequences of buying and selling land without going through the official who made the land deed in Pekanbaru and what are the legal consequences of buying and selling land without going through the official who made the land deed in Pekanbaru This study uses the Sociological legal research method (empirical) or observational research (observational research) which is descriptive in nature which describes the facts studied in the field used are primary data and secondary data analysis by survey method. The location chosen to conduct this research is in Kulim District and Tenayan Raya District, researchers conducted interviews with sub-district staff The legal consequences of buying and selling land without going through a deed making official in Pekanbaru. It happened because the transfer of land rights could not be formed or the related transfers were invalid, there was no legal guarantee and legal protection for the land. From 26 samples of buying and selling in Kulim sub-district, in the Kulim sub-district has 6 samples that have problems due to buying and selling land without going through an official making land deeds and similarly the 30Tenayan Raya sub-district has 10 samples in the sub-district that have problems due to buying and selling land without going through a land deed making official. Legal Impacts of Buying and Selling Land Without Going Through Officials Making Deeds In Pekanbaru In addition to difficulties in registering land rights, there is also an even bigger impact if one day there is a legal issue related to the land that is the object of sale and purchase. Land buyers will experience difficulties in proving because an agreement under the hand will have a lower position than a sale and purchase deed made under a PPAT, which is an authentic deed which is contained therein so that it has absolute evidentiary value.
