Abstract

One of the e-commerce in Indonesia is shopee. Shopee now has many features to make shopping easier for consumers, starting from how to pay with shopeepay, how to pay cash on delivery (COD), and others. Cash On Delivery (COD) is a payment method offered by Shopee to make it easier for buyers to make payments without opening an account at a bank or credit card, and if they are not close to several outlets that partner with the e-commerce company, such as Alfamart and Indomaret. In all these conveniences, there are also weaknesses and disadvantages when using Cash On Delivery, namely there is a possibility that Shopee users refuse to pay for the goods that have been ordered so that business actors experience losses in terms of packaging, shipping and time which are a burden for business actors. Not only that, delivery by the sender service as a service to support the COD payment system also causes losses Based on the above, the formulation of the problem is: (1) How is the practice of buying and selling with the Cash On Delivery (COD) payment method at Shopee? (2) How is the Legal Protection of Business Actors in Online Buy and Sell Transactions with the Cash On Delivery (COD) Payment Method at Shopee? This research is a juridical-empirical research, through a qualitative approach. The research was carried out with data collection methods in the form of literature studies, interviews and questionnaires. The technique used is qualitative analysis, the research is analyzed qualitatively and then presented descriptively, namely by describing, explaining and describing the data obtained and connecting one to another to get a general conclusion. The practice of buying and selling with the Cash On Delivery (COD) payment method has not gone well. There are parties who do not perform their performance against an agreement in conducting an online buying and selling agreement. In online buying and selling transactions there are various kinds of obstacles and obstacles felt by the seller. This can be seen from buyers who do not want to pay, buyers not being at home when the goods are delivered by couriers, and various other obstacles. This is very detrimental to the seller as a business owner, namely in terms of packaging, shipping and time which is a burden for the seller. Basically, the Civil Code, PP No.82 of 2012, ITE Law and PK Law have regulated the protection of business actors or consumers but do not explicitly regulate the responsibility of consumers who do not carry out their obligations.
