Abstract

With this study, the author researches about "Criminal Law Enforcement by the Drug and Food Supervisory Workshop in Indragiri Hulu Regency against Business Actors Who Distribute Traditional Medicines Without Distribution Permits in Indragiri Hulu Regency", the author's reason for researching and raising the title of this research is: to identify the criminal law enforcement carried out by the POM Workshop against manufacturers who sell illegal traditional medicines in Indragiri Hulu Regency. To identify the obstacles faced by law enforcers related to the handling of illegal traditional medicine trafficking that results in perpetrators not deterring. This research establishes the formulation of the problem, including: 1) How to implement criminal law enforcement by PPNS Loka POM against business actors who distribute traditional medicines without a distribution permit in Indragiri Hulu Regency. 2) What factors are obstacles in the enforcement of criminal law by Loka POM against business actors who distribute traditional medicines without a distribution permit in Indragiri Hulu Regency. This study uses the empirical normative law research method, Empirical normative law research is a method that combines a normative law approach with empirical symptoms. This method is related to the implementation of the rule of law (normative law) in the process in every specific legal event that takes place in the midst of society. Data analysis is carried out qualitatively, namely by describing and comparing the data with the provisions of applicable laws and regulations. Meanwhile, the method of drawing conclusions used is the deductive method, which is drawing conclusions from things that are general to things that are specific. The findings of the study prove that: 1) law enforcement by the POM Workshop in Indragiri Hulu Regency in alleviating the distribution of illegal traditional medicines has not been carried out optimally. This condition can be seen from the number of manufacturers who sell illegal traditional medicines or without distribution permits. 2) things that hinder the local POM Workshop in law enforcement against the distribution of illegal traditional medicines that make the perpetrators undeterred are due to obstacles from an internal and external perspective.
