Abstract

Water transportation accident crime that results in victims passed away as stipulated in article 323 paragraph (3) Jo article 219 paragraph (1) regarding shipping, in this case what is meant by an accident Water Transportation which resulted in the death of the victim. Case Case Decision Number: 171/Pid.sus/2018/PN. Tembilahan, in the decision Judge The Tembilahan District Court has stated that the actions of the defendant H. Musbah als H. Atan Bin Usman, has fulfilled the formulation of a criminal offense in Article 323 paragraph (3) of Law Number 17 of 2008 Concerning Shipping. The main problem in this research is first, how the application of criminal law to the crime of water transportation accidents resulted in the death of the victim in the case of decision No 171/Pid.sus/2018/PN. The findings and considerations of the Panel of Judges in pass a decision on the criminal act of Water Transportation accident which resulted in the death of the victim in the case of decision No 171/Pid.sus/2018/PN. Tembilah. Research when viewed from the type of research classified as research Empirical law is a legal research method that uses empirical facts taken from human behavior, taken from interviews and behavior real to find answers about what each problem should be studied based on secondary data consisting of three (3) legal materials primary, secondary and tertiary. Meanwhile, when viewed from its nature, this research is descriptive, namely explaining in the form of clear and detailed sentences regarding the juridical purpose of the Water Transportation Accident crime resulted in the death of the victim case decision Number 171/Pid.sus/2018/PN. Tembilah. Proof of criminal acts of violation of article 323 (3) in conjunction with article 219 (1) in water transportation accident case resulting in the death of the victim in decision Number 171/Pid.sus/2018/PN. Tembilah. Made by the prosecutor public prosecutor by presenting as many as 5 (five) witnesses. Proof given by the Prosecutor was refuted by 2 pieces of evidence and expert testimony witness testimony in favor of the accused. Legal Considerations of the Panel of Judges Decide Case Number 171/Pid.sus/2018/PN. The bills that stated that the defendant has been proven guilty of committing the crime of the captain sailing without having a sailing approval letter issued by Syahbandar caused a ship accident resulting in death, and on the basis of The Defendant was sentenced to imprisonment for 3 (three) months.
