Abstract
Elections in modern democracies are an important part of forming a state and government. General elections are considered as a very clear form of implementing democracy. If democracy is defined for and by the people as a government, elections are carried out by them. Elections are a manifestation of the implementation of sovereignty and the most concrete form of participating people for the administration of the state. The main problem in this study is how are the characteristics of direct presidential elections viewed from the fourth Pancasila precept. What are the obstacles in the direct presidential election? Viewed from the Fourth Pancasila Precepts. This study uses the legal research method observational research or survey where in this study collects information from respondents using a data collection tool in the form of interviews and the nature of this research is analytical descriptive, namely the research provides data as accurately as possible to describe how the characteristics of the Presidential Election are Directly Viewed from the Pancasila Precepts Fourth. The results of the study show that the characteristics of representative deliberations in the presidential election system in Indonesia are based on five aspects, namely agreement, togetherness, openness, kinship and representation, namely (a) the old order periodization period 1945-1966 was categorized as transformative because the five aspects of representative deliberations were not fulfilled and the regulations that The underlying changes to independence began with Article III of the transitional rules of the 1945 Constitution, then replaced with Article 2 of the 1949 RIS Constitution and Article 45 of the 1950 Constitution, and finally ratified the presidential decree to make Sukarno president for life. (b) The periodization of the New Order period from 1966-1998 was categorized as justificative after it was confirmed by the MPRS in 1968 and then continued to be elected every five years by election based on MPR Decree No. II/MPR/1973 left the five aspects of representative deliberation. (c) During the 1999-2004 transitional period, the presidential election system was categorized as representative deliberative which carried out the five aspects of deliberation on the legal basis of Article 6 paragraph (1) and (2) of the 1945 Constitution. (e) The post-amendment reform era of the 2004-2024 presidential election system was categorized as liberal because it eliminates the five aspects of deliberative representation by transplanting the law from the United States presidential election system stipulated in Article 6A and Article 22E of the 1945 Constitution of the Republic of Indonesia. Obstacles in direct presidential elections Judging from the fourth Pancasila Sila, prone to horizontal conflict, high cost of holding elections, and the practice of money politics (money politics).
