Abstract
Shopee is the first e-commerce company in Indonesia that has its own food delivery service. ShopeeFood is an online food delivery service. Customers can order food using the Shopee Food feature in the Shopee application, which is then delivered to the customer's home by ShopeeFood driver partners. Because Shopee Food is a newcomer compared to its competitors, there is a need for research to look at legal protection for consumers who use Shopee Food's online food and beverage delivery service. The formulation of the problem raised in this study, namely: What is the legal protection for consumers who use the shopee food delivery service according to Law No. 8 of 1999 concerning consumer protection and what are the obstacles in legal protection for consumers who use food and beverage delivery services shopee food according to law number 8 of 1999 concerning consumer protection. This research is included in the category of normative-empirical law. Normative-empirical law is an understanding of law in the sense of norms (rules) and the implementation of legal rules in real behavior as a result of the enforcement of legal norms. Based on the results of the study, it shows that: Legal protection for consumers who use food delivery services and shopee food drinks According to Law Number 8 of 1999 concerning Consumer Protection is divided into several stages, namely: the Shopee (shopee food) stage, Drivers, and from Consumers. Protection from the Shopee (shopee food) side, namely Shopee (shopee food) has tried to provide the rights that consumers should get, Protection from the Driver side, namely Drivers have carried out their obligations to deliver food and drinks properly to consumers, and Protection from the Consumers, namely consumers feel they do not get the rights as they should. Constraints in legal protection for consumers who use online food and beverage delivery services According to Law Number 8 of 1999 concerning Consumer Protection are influenced by several inhibiting factors that cause consumer rights to not be fully realized properly and correctly, including: lack of insight and consumer knowledge of the consumer dispute settlement agency (BPSK), lack of insight and knowledge of consumers and drivers about their respective rights and obligations, consumers who are less concerned about the problems that occur and offices and shopee customer service do not have branches making it difficult for consumers to express opinions and complaints.
