Abstract

The decision of the Padang Religious Court with case number 677/PDT.G/2019/PA.PDG in the case of living hadhanah with the case of ex-husbands having made a peace agreement which was legalized before a notary containing the maintenance of children and ex-husbands apparently did not comply the contents of the agreement and in this decision the agreement made by the parties was declared null and void by law by the panel of judges. Based on the above background, the following problem formulation is drawn: 1) What is the position of the judge's legal considerations at the Padang Religious Court in deciding the Hadhanah subsistence case in decision 677/Pdt.G/2019/PA.Pdg. 2) What is the strength of the proof of the peace agreement that has been legalized by a notary in court. The research method used in this research is the library research method. The analysis of Decision Number 677/Pdt.G/2019/PA.Pdg which was reviewed was based on books in the library and used the deductive conclusion method. The judge's decision at the Padang Religious Court in the Hadhanah subsistence case at decision 677/Pdt.G/2019/PA.Pdg stated that the agreement made by Surya Fajriani as the "plaintiff" with Rissaldi Zain as the "defendant" was null and void due to legal defects in the agreement such as the existence of an element of "coercion" on the part of the plaintiff SF and the defendant RZ was harmed in this agreement.
