Abstract

Indonesia is a unitary country that has a diversity of forms and cultures based on each region. Tapung Hulu District, Kampar Regency, Riau Province is one of the areas that carries out a customary mixed marriage process by applying the Batak Mandailing traditional legal system. This is done to determine the legal status of the marriage in the eyes of custom, religion and the government and also has clear legal consequences. The formulation of the problem in this thesis research is: First, what is the process of implementing mixed customary marriages in the Batak Mandailing customary legal sistem in TapungHulu District, KamparRegency, Riau Province. Second, what are the legal consequences for children as a result of mixed customary marriages in the Mandailing Batak Customary Legal System in Tapung Hulu District, Kampar Regency, Riau Province. This research method uses an empirical legal approach. This method is used to obtain the truth in existing discussions and to see the application of legal rules in society. The analysis was carried out descriptively which will describe and explain how mixed customary marriages are implemented in the Mandailing Batak Customary Law System in Tapung Hulu District, Kampar Regency, Riau Province. Theresults of the thesis researchthat the author found are asfollows: First, explaining the process of implementing traditional mixed marriages in the Mandailing Batak traditional law sistem, where the implementation of traditional mixed marriages goes through stages such as: Manyapai Boru, Mangaririt Boru, Padomos Hata, Patobang Hata, Manulak Sere, Horja Haroan Boru, Marpokat, Mangalop Boru, Panaek Godang, Mata Ni Horja, Mangalehen Gorar, Mangupa. Second, determining the legal consequences for children resulting from mixed marriages by granting the title of king to the child with the agreement of the local traditional kings.
