Abstract
The air transportation system in Indonesia still has some drawbacks such as the phenomenon of damage or loss of checked baggage belonging to passengers at PT. Garuda Indonesia at Sultan Syarif Qasim II Airport in Pekanbaru. In Law Number 1 of 2009 concerning Aviation, the procedure for handling baggage has been regulated in such a way, but in practice, things that are not wanted by the airline PT. Garuda Indonesia and the passengers. Based on the background, the authors formulated the main issues includ: First, what form the responsibility of PT. Garuda Indonesia against the transportation of lost baggage on domestic flights. Second, what kind of constraints are faced by the airline PT. Garuda Indonesia for lost luggage on domestic flights. Type of research includes empirical legal research methods and in this research survey the author directly collects data and interviews with PT. Garuda Indonesia and also to passengers who experience losses in their checked baggage. While the nature of this research is descriptive, namely this research describes in detail and details the damage and loss of checked baggage. PT. Garuda Indonesia has fulfilled its responsibility for damage or loss of checked baggage which has been carried out properly by the Lost & Found officers in accordance with what is stated in Law Number 1 of 2009 Article 1 Paragraph 24 Concerning Flights and checked baggage. However, damage or loss of checked baggage still occurs frequently and is a separate obstacle for PT. Garuda Indonesia in flight transportation to make compensation to passengers due to administrative constraints to provide responsibility for lost baggage (incomplete proof of ownership of lost passenger luggage such as boarding pass personal data, baggage tags and others), passengers do not follow SOP rules applicable complaint or baggage claim mechanism. The handling of compensating for lost checked baggage experienced by passengers is an obstacle in carrying out the rules of Law Number 1 of 2009 concerning Aviation and Regulation of the Minister of Transportation Number 77 of 2011 concerning Responsibilities of Air Transport Carriers.
