Abstract

Punishment of State Civil Apparatuses in the Riau Kanwinkum environment. Where the punishment is based on a violation of office, abuse of authority to those who are directly involved in the mode of criminal acts such as the distribution and use of narcotics. From the fact that several of these cases were also not a few state civil servants who were sentenced to dishonorable dismissal in the Legal Area of the Riau Regional Legal and Human Rights Office, especially how the process, proof and sentence mechanisms were applied to state civil servants who committed crimes. Based on this phenomenon, this study aims to examine and analyze the Sentencing of State Civil Apparatuses Who Commit Crimes in the Riau Regional Legal and Human Rights Offices and the Procedures for Imposing Punishments Against State Civil Apparatuses Who Commit Crimes in the Regional Legal and Human Rights Office Environments Riau Human Rights. This research is included in the normative juridical and empirical juridical research groups. The normative juridical approach is legal research that places law as a building system of norms. Empirical juridical research is research that has an object of study regarding the Imposition of Punishment Against Individual State Civil Apparatuses Who Commit Crimes in the Riau Regional Legal and Human Rights Office Environment. Research results: Based on article 247 PP No. 11 of 2017 jo. PP Number 17 of 2020 Concerning Civil Servants Management, the imposition of discipline on civil servants who commit criminal acts within the Menkumham Riau environment in 2020 to 2023 there are 11 ASNs. The perpetrators of the criminal act of corruption totaling 2 people were sentenced to dishonorable dismissal, because the person was sentenced to the Pekanbaru court for 3 years in prison. The criminal act of narcotics users and dealers as many as 4 people with a dishonorable discharge penalty based on the Pekanbaru court decision was sentenced to 4 years in prison. crime of falsifying personal identity when registering for Civil Servants at the Ministry of Law and Human Rights, is sentenced to 4 years in prison. Individuals who falsify their identity at the time of registration for CPNS are subject to disciplinary punishment with dishonorable dismissal on the basis of a criminal decision from a court for 4 years in prison. The procedure for imposing disciplinary sanctions against state civil servants who commit criminal acts refers to Permenkumham no. 28 of 2019 which consists of Summons for Employees, Examination of Employees, Issuance of Minutes of Examination and Reports of Examination Results, Determination of Decisions on Imposing Disciplinary Punishments, Enforcement.
