Abstract
This research aims to find out the evidence regarding the Proof of the Crime of Embezzlement (Case Study Decision Number: 46/Pid.B/2024/PN Pbr. To find out the legal considerations of the panel of judges in deciding the criminal case Number: 46/Pid.B/2024/PN Pbr. This type of research is normative law with a descriptive nature. The types and sources of data used are primary legal materials and secondary legal materials. The conclusion drawn in this research is an inductive method. The results of this research concluded that the proof of the criminal act of embezzlement in case Number: 46/Pid.B/2024/PN/Pbr was correct. Where the public prosecutor charges the defendant with an indictment that has been described. The public prosecutor in the District Court's decision has complied with the provisions of Article 143 paragraph (2) of the Criminal Procedure Code and the material criminal law as charged in the first indictment, namely that the defendant violated Article 378 of the Criminal Code or the second indictment, Article 372 The Criminal Code where the elements charged by the public prosecutor are considered legally and convincingly proven is Article 372 of the Criminal Code because the defendant committed the crime of embezzling other people's property in the form of 1 (one) motorbike and 1 (one) unit, so it was declared proven guilty of committing the crime of "embezzlement" in the indictment. With this, the panel of judges, after obtaining more than 2 items of evidence from the public prosecutor with full confidence, the panel of judges imposed a prison sentence of 1 year and 6 months.
