Abstract
This research addresses the land acquisition for infrastructure projects on privately owned land in Lingga, Indonesia, rooted in the legal framework established by the 1945 Constitution and subsequent agrarian laws. Despite Indonesia's commitment as a "rechtstaat," the effective implementation of regulations often falls short, leading to challenges in land acquisition processes. The primary aim of this study is to investigate land acquisition for infrastructure projects on private property and to identify the obstacles encountered during this process in Lingga. Utilizing a normative-empirical legal research methodology, a descriptiveanalytical approach was adopted, focusing on regulatory frameworks and their practical implications. The research was conducted at the Lingga Regency Government Office, involving of ten respondents, including landowners and officials from relevant government departments. Data was collected through interviews and analysis of official publications. Findings indicate that land acquisition for infrastructure projects aligns with existing legal provisions, emphasizing the importance of fair compensation to landowners. However, challenges persist due to a lack of public understanding regarding compensation mechanisms, coupled with insufficient socialization efforts prior to the acquisition process. Despite these issues, the study concludes that the land acquisition process generally adheres to legal requirements, with the government retaining an obligation to negotiate fair compensation in cases of disputes. This research has implications for improving public awareness of land rights and compensation processes, ultimately contributing to more effective governance and infrastructure development in Indonesia.
