Abstract
This thesis research is motivated by Law Number 8 1999 concerning Consumer Protection, consumers have the right to comfort, security and safety when consuming goods and services. Apart from that, business actors are responsible for fulfilling their obligations by providing correct, clear and honest information about conditions and guarantees for goods and/or services as well as instructions regarding use and maintenance. According to data from the Food and Drug Administration Center in Pekanbaru, that in 2021 shows 9 Licensed Drug Stores (TOB) in accordance with the provisions applies while 9 Licensed Drug Stores (TOB) do not comply with the wrong provisions the other is in the event that the procurement of medicines does not come from PBF but from facilities other pharmaceutical services, Procurement of medicines from unofficial sources, ie freelance or canvas. This research takes the form of (1) How is consumer protection against freelance drug distribution at licensed drug stores in Pekanbaru. (2) How obstacles and efforts to distribute freelance medicines at licensed drug stores in Pekanbaru. The type of research used in writing this law is Sociological legal research is an approach to the problem being studied with characteristics laws that are real or in accordance with the realities of life in society. The research method used is a mixed research method research method). The population in this study involved 20 people, including 18 licensed drugstore entrepreneur and 2 BPOM Pekanbaru staff. Sample of this research consisting of 9 licensed drugstore entrepreneurs and 2 BPOM Pekanbaru staff members, a total of 11 people. The results of this research are: Based on the BPOM annual report In Pekanbaru, in 2021, data was obtained that there were 9 TOBs that did not comply provisions, one of which is due to the procurement of drugs from other sources official, namely freelance or canvas, drug supplies from freelance salesmen or canvas with a communication scheme, namely freelance salesman or direct canvas visited the shop and with an undetermined frequency. Freelance sales or canvas sells TKK drugs which include hard drugs as well as drugs with code G. Distribution of drugs that still come from unofficial sources such as freelance sales or canvas are clearly not in line with BPOM regulations, thus in accordance with article 4 of BPOM regulation no. 6 of 2020 follow-up supervision is required in the form of: technical guidance and/or administrative sanctions.
