Abstract

E-commerce is a commercial transaction that does not require the physical presence of the seller and buyer. This activity requires a strong level of trust between both parties. Shopee is one of the largest and most popular marketplace organizers in Indonesia which takes the form of a mobile ecommerce application which functions as an online shopping platform, facilitating convenient buying and selling transactions only via mobile devices. One of the interesting features offered by Shopee is the Cash On Delivery payment method (COD). Cash On Delivery (COD) is a newly introduced transaction method where payment for purchased goods is made upon arrival at the buyer's location via courier, without the need for prior payment. The Cash On Delivery (COD) system can also cause problems. Many buyers have the perception that the goods they purchased are not suitable, which causes them to refuse payment for the goods and even ask for a refund directly from the courier and there are also those who threaten or curse at the courier even though the courier is only a third party in delivering a package, because of the many incidents that harm the party. The courier must have legal protection for the courier. This research includes a problem formulation consisting of, First, what is the legal protection for J&T Express Pekanbaru couriers and secondly, what are the legal regulations for cash on delivery transactions in e-commerce. The research method used in this thesis research is normative – empirical or mixed research which examines relevant legal standards so that implementation takes place in the community and connects them with facts in the field according to observations. This research uses an observational research method by conducting a survey directly in the field. Data collection tools through observation, interviews and photo documentation. This research analyzes data qualitatively and uses a deductive method of drawing conclusions. Based on the research results, it can be found that legal protection for J&T express couriers has not been implemented optimally by the J&T company regarding the case of the Cash On Delivery payment method, resulting in many cases that are detrimental to the courier. In implementing Cash On Delivery, the government has not made special regulations to protect the parties involved, only regulations governing the implementation of buying and selling in e-commerce.
