Abstract

The protection of children who work outside of work relationships in Pekanbaru City has not fulfilled the rules set out in Article 75 of Law Number 13 of 2003 concerning employment. Therefore, to find out the form of legal protection for child labor outside the employment relationship in Pekanbaru City, the authors conducted direct research in the field with research indicators in the form of agreements, wages and supervision of child labor outside the employment relationship in Pekanbaru City. Based on these indicators, the authors formulate a research problem, namely what form of legal protection is provided to children who work outside of employment relations in Pekanbaru City and what are the obstacles encountered in providing legal protection to children who work outside employment relations in Pekanbaru City. The method in this study is Observation Research which is carried out by conducting a survey, namely by conducting research directly by coming to the research location using a data measuring tool in the form of interviews. This research is descriptive in nature, that is, it provides a clear and detailed description of the main problem to be examined. Based on the results of research conducted by the author, that in providing legal protection to child workers who work outside the employment relationship in Pekanbaru City, it is felt that they have not worked optimally and there is still a slight discrepancy between implementation and Law Number 13 of 2003 concerning Manpower, Law Number 20 of 1999 concerning Ratification of ILO Convention No.138 of 1973, Law Number 1 of 2000 Ratification of ILO No.182 of 1999. Where until now there is still the phenomenon of children working in the informal sector, this can almost always be found in all existing areas in Indonesia, especially Pekanbaru City.
