Abstract

E-commerce or electronic commerce is included as a product generated through time. This type of business transaction gives various advantages and conveniences compared to transactions carried out online offline or conventional. The problem that the researcher will raise is related to legal protection for consumers who make purchases for an item from the Shopee app. The goal is to understand how the law is in Indonesia in providing protection to consumers and how government efforts to renew or develop legal protection for consumers doing e-commerce transactions. The method applied for the implementation of this research is law normative, by using the statute approach (legislation approach) and conceptual approach (conceptual approach). Use Law Number 8 of 1999 (UUPK), Law Number 19 2016 (UU ITE), as well as Law Number 33 of 2014 (UU JPH) as primary legal material. Then for secondary legal material use various books in relation to consumer protection, electronic commerce, and use the articles and journals obtained from the Internet. Furthermore, it also uses tertiary law to support research, with sources from dictionaries, encyclopedias, and the like. The conclusion obtained is that consumers are given protection law by Law no. 8 of 1999 (UUPK), fully for conventional as well as internet-based transaction actors are global, then this protection is supported through Law no. 19 of 2016 (UU ITE) and the United Nations Commission on International Trade Law (UNCITRAL). But then the government in November 2019 released Government Regulation no. 80 of 2019 concerning Trading Through the System Electronic, where through the existence of these regulations it is expected to be able to providing a balance between consumers and business actors both from local to foreign business actors, and can spur aspects of growth e-commerce sector in Indonesia.
