Abstract

Fornication is one of the main causes of destruction on civilization, from spreading precarious diseases, encouraging people to continue to live single and live together withour marriage, adultery to fornication and prostitution. This certainly has an appalling impact on Indonesian citizens. In my current research entitled “Pros and Cons Analysis : The existence of Adultery Offense as Ordinary Offense” which intends to learn about basis of the mind on both side of the pro-group and the con-group about the existence of the offense of adultery as an ordinary offense. This research is included as the Normative Jurdical research typeologi. The legas review focuses more on the norms established at the time or the norms stated in law. The result of this study show that the basis for community groups who support and agree with the expansion on the meaning of the offense in adultery is because they consider article 284 of the Criminal Code to be inefficient to apply in Indonesia. Essentially, Indonesian society is known for its Eastern Custom, where the community upholds customary values and also norm that applu and develop in the Indonesian community, it because important for eastern customs because it is heritage passed down by ancestors and has continued until now. Then the basic things that make people fail to agree and reject this expansion is because they are consider this expansion of the meaning of adultery is overly regulating ones private affairs or spehere, and it is certain that there will be a lot of persecution and vigilante culture, because society will compete to be the moral police and intervene in the private affairs of others.
